Child custody and visitation orders may be modified at any time while the child is still a minor.  The general rule in California is that a court may modify a custody or visitation order only upon a showing of a “substantial change in circumstances” since the previous order was made.

Child custody and visitation orders can be modified with the consent of both parents or by the court. All parts of the previous order can be changed as long as it is consistent with the "best interests of the child." Typical justifications for an alteration in child custody or visitation are:

  • Relocation - Parent with physical custody wishes to move-away from non-custodial parent.
  • Substantial change in circumstances - Anything significant that disrupts the stability of the child's life (i.e. parent's loss of job, relocation, illness) may warrant modification.
  • Change in lifestyle - Modification may be justified if substantial changes in a parent's lifestyle.
