Many people assume that courts will automatically grant primary custody of the children to their mother. At The Cerda Law Offices, we do not approach child custody cases with this assumption. We know that child custody and child support are often the most disputed areas in divorce negotiations by both mother and father as they affect both emotions and money. Indeed, one of the most contested issues of dissolution is determining where the children will live and who has decision-making powers over their activities.
Often a parent will come and tell us that they don’t want the other parent to have anything to do with the children. However, California’s official policy is to assure that children have frequent and continuing contact with both parents and to encourage parents to share the rights and responsibilities of their children. The primary exception to policy is when it is not in the best interests of the children to do so. Thus, many different types of child custody arrangements are possible, depending on the unique circumstances of the parents and, most importantly, the best interests of the child.
